What is Personal Injury Law?
 
 
 
Personal injury law, also called torts, are general civil litigation cases in which the plaintiff generally seeks damages for physical, mental, or emotional injury that was caused by the defendant's intent or negligence.
 
Common intentional personal injury cases include: assault, battery, intentional infliction of emotional distress, defamation, trespass, and conversion.  Although many of these same offenses can be brought in the criminal courts by the state to punish the defendant; personal injury cases are brought in the civil court by the plaintiff to enforce their right to be compensated for the wrong against them. In Texas, these cases generally must be filed within two years of the injury, or the plaintiff will lose their claim against the defendant.
 
 
The basis of a negligence case is that the plaintiff must prove that the defendant had a duty to act in a manner to protect others against unreasonable risk, and that the defendant's failure to take reasonable care is what caused the plaintiff's injury.  If the plaintiff proves the defendant was unreasonably negligent, the plaintiff can recover for pain and suffering and other losses related to those personal injuries.  Common types of personal injury cases are vehicle collisions (car, bus, truck, motorcycle accidents; as well as, pedestrian, bike injury caused by motor vehicle collision), negligent hiring, training, and/or supervision of employees, premises liability, slip and fall, trip and fall, products liability, and wrongful death.
